DayDrop Vendor Terms

Last updated 1 November 2026

These terms are an agreement between you, the business listing on DayDrop ("you", "vendor"), and Arman Oganesian, a sole trader in New Zealand trading as DayDrop ("DayDrop", "we", "us"). They apply to your use of DayDrop to list products and take reservations. Our Privacy Policy and Acceptable Use Policy also apply.

By registering as a vendor you confirm that you are in trade, that you are using DayDrop for your business, and that you have authority to agree to these terms for the business.

1. What DayDrop does

DayDrop is a listing and reservation platform. We let you publish your stall and daily deals ("drops"), let buyers reserve them, and give you tools to manage pickups.

You are the seller. Every sale is a contract between you and the buyer. DayDrop does not buy, sell, handle, store, deliver or take payment for your products, and is not your agent. Buyers pay you directly. You set your prices, quantities, descriptions and pickup times.

2. Your account and stall

  • You must be 18 or older, and if you act for a business, authorised to accept these terms for it.

  • Give accurate information about your business, including your name, address, location, contact details and categories, and keep it up to date.

  • Your NZBN is optional. If you enter one, it must be your own business's number and correct. By entering your NZBN you agree that we show it on your public stall page. You can remove it at any time in the app, and it stops being shown. We may check it against the NZBN register.

  • Keep your sign-in secure and only let authorised people use your account.

  • Your stall address and map pin are shown to all buyers, exactly as you enter them, so they can find you to pick up. By entering an address you agree that it is shown publicly. If you sell from home, your home address will be public.

You, not DayDrop, are responsible for your products. You alone are responsible for what you sell and how you make, store, label, describe and hand it over, for holding and keeping current every registration, licence, permit and approval your business needs, and for food safety. DayDrop does not check, inspect, approve or guarantee your products, premises or permits, and is not responsible for them. Any number, badge or document shown on your stall is information you gave us.

You are solely responsible for complying with all laws that apply to your business and products, including:

  • Food Act 2014: being registered under the correct Food Control Plan or National Programme, or being exempt, and keeping that registration current. If your registration lapses, is suspended or cancelled, you must stop listing affected products and tell us.

  • Animal Products Act 1999 for meat, fish, eggs, dairy, honey and other animal products as applicable.

  • Labelling and composition: the Australia New Zealand Food Standards Code, including allergen and ingredient information when required.

  • Fair Trading Act 1986 and Consumer Guarantees Act 1993 towards your buyers: accurate descriptions and prices, and honouring consumer guarantees.

  • Weights and Measures Act 1987 where you sell by weight or measure.

  • Any council bylaws, permits and licences for your premises or stall.

Information you give us about your Food Act status must be true. Your Food Act details are your own declaration: you enter your registration type, number and expiry (or why you are exempt) and confirm in the app that they are true. DayDrop does not review or approve them before you can post. Your Food Act registration type and number are shown on your public stall page (as your declaration, with a link to the public MPI register); by entering them you agree to this. If you are exempt, we show only that you declared an exemption, not your reason. Vendors selling meat, fish or ready-to-eat meals must hold a Food Control Plan (or other registration we accept), and meat and fish vendors must confirm they do not sell homekill meat. We may ask for evidence (for example your registration certificate) at any time, may display your registration details, and may refuse, hide or remove listings while we check. DayDrop does not certify food safety. Showing registration details or a badge in the app means only what we describe in the app, and does not mean we have inspected you.

4. Listings

  • Listings must be accurate, lawful, and for products you have available for pickup at the stated time and place.

  • Include allergen and dietary information buyers would reasonably need, or tell buyers to ask you.

  • Use your own photos, or photos you have the right to use, that show the actual product.

  • Honour confirmed reservations. If you cannot, cancel in the app as early as possible.

  • Do not ask buyers to pay a different price from the listing without telling them before they pay.

5. Reservations and pickups

  • Scan the buyer's pickup QR code at pickup and record in the app what they take, take in part, or do not want, so records stay accurate. Do not record an item as not wanted unless the buyer said so.

  • Reservations not collected by the pickup time are marked as missed automatically.

  • Deal with buyer complaints and refunds yourself, in line with consumer law. See Refunds and Complaints.

6. Prohibited and restricted products

You must not list the following on DayDrop. This list is a summary and does not replace the law; if in doubt, ask MPI or your council before listing, and ask us.

Prohibited on DayDrop:

  • Homekill meat or meat from animals killed by a homekill or recreational-catch service provider. Homekill meat is for the owner's own use and cannot be sold.

  • Wild game of any kind (for example wild deer, pig, goat, rabbit, game birds), even if processed.

  • Recreationally caught fish, shellfish or other seafood. Fish and shellfish you sell must be commercially and lawfully harvested and handled.

  • Alcohol, including home brew, wine, beer and cider.

  • Tobacco, vapes and nicotine products.

  • Medicines, supplements or products with therapeutic or health claims, and products containing CBD or THC.

  • Unwanted organisms, pest plants or other items restricted under the Biosecurity Act 1993.

  • Raw (unpasteurised) milk and raw milk products sold as drinking milk.

  • Wild-harvested foods, such as foraged mushrooms, seaweed or wild plants.

  • Weapons, fireworks, hazardous substances, counterfeit or stolen goods, and anything illegal to sell in New Zealand.

Restricted (allowed only if you meet the legal requirements, and we may ask for evidence):

  • Eggs: egg producers must meet MPI requirements for their flock size and sale method.

  • Honey and bee products: must meet MPI requirements, including the tutin standard for honey.

  • Meat and fish: only from registered processors and only with a Food Control Plan (or other registration we accept) for your business.

  • Ready-to-eat meals: only with a Food Control Plan (or other registration we accept) for your business.

We may remove any listing we reasonably believe breaks this section or creates a safety risk.

Permanent block. Listing a prohibited product is a serious breach. If you do, we may close your account and stall permanently and without warning, and refuse any new account from you, including accounts using the same email, phone number, NZBN or Food Act registration. If you think we made a mistake, contact [email protected].

7. Content licence

You keep ownership of the photos, text, logos and other content you upload ("your content"). You give DayDrop a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize, display and share your content to operate and improve DayDrop and to promote your stall and DayDrop (for example on our website, app store listings and social media). This licence ends when you delete the content or your account, except for promotional material already published, copies in backups for the retention period, and where we need to keep records for legal reasons.

You confirm you have the rights to upload your content and that it does not infringe anyone else's rights. You must not upload images that show people without their permission.

8. Buyer information

You will see some personal information about buyers: their display name, their profile photo if they added one, and the reservation details. You do not see buyers' email addresses, phone numbers or any other account details. Use this information only to fulfil that reservation and to deal with related questions or complaints. Do not use it for marketing unless the buyer has separately agreed, do not share it, and keep it secure. Comply with the Privacy Act 2020 and the Unsolicited Electronic Messages Act 2007.

9. Pilot, pricing and payment

Pilot. DayDrop is free for vendors until 28 February 2027.

After the pilot. From 1 March 2027 the vendor subscription is NZ$20 per month. You can cancel at any time.

GST. DayDrop is not registered for GST, so no GST is added to these prices. If DayDrop becomes GST registered, the same prices will include GST; the amount you pay does not go up because of it.

Founder price. Vendors we invite as founders pay NZ$10 per month instead of NZ$20. You keep the founder price for as long as your subscription continues. If your subscription is cancelled (by you, or because payment fails and is not fixed), the founder price ends; a new subscription is at the normal price unless we choose to offer the founder price again. Your plan is shown in the app under Subscription.

Free plan. We may give some stalls a free plan at our discretion, and may end it with at least 7 days' notice.

How the switch works.

  • We will remind you at least 7 days before the pilot ends.

  • You will not be charged unless you choose a plan and add a payment method.

  • From 1 March 2027 the app shows you a notice, and you have 7 days to subscribe. Your stall stays open during those 7 days.

  • If you have not subscribed after 7 days, your stall is paused: buyers no longer see it or your drops, and no new reservations can be made. Reservations made before stay valid, and you should honour them. Your stall, drops and history are kept, and subscribing opens your stall again.

  • Subscriptions renew automatically each month until cancelled. Cancelling stops the next renewal; you keep access until the end of the period you have paid for. We do not give partial refunds for unused time, except where the law requires or we decide otherwise.

  • Subscription payments will be processed by our payment provider, Stripe, by NZ direct debit or card, once paid plans open. DayDrop never takes payment for your products.

Price changes. We may change subscription prices with at least 7 days' notice. The new price applies from your next renewal after the notice period. If you do not agree, you can cancel before it applies.

10. Suspension and removal

We may hide or remove listings, or suspend your stall or account, if we reasonably believe:

  • you have breached these terms or the Acceptable Use Policy;

  • a product or listing creates a food safety, health or legal risk;

  • your Food Act registration or NZBN is invalid, expired, suspended or closed;

  • we receive credible complaints, or are asked to by an authority; or

  • your subscription is unpaid after the pilot.

If you breach these terms or the Acceptable Use Policy, we may act immediately and without notice. In other cases, where reasonable and lawful, we will tell you the reason and give you at least 7 days to fix the problem first. In urgent cases (for example a food safety risk) we may also act immediately and tell you afterwards. You can ask us to review a decision through Support in the app.

11. Ending this agreement

  • You can stop using DayDrop and delete your stall or account at any time.

  • We can end this agreement for convenience with at least 7 days' notice, or immediately and without notice if you breach these terms or the Acceptable Use Policy, or where required by law.

  • If we end the agreement for convenience during a month you have paid for, we will refund the unused part of that month's fee.

  • Sections 3, 7 (to the extent stated), 8, 12, 13 and 14 continue after this agreement ends.

12. Indemnity

You agree to indemnify DayDrop against claims, losses and reasonable costs arising from: your products (including food safety, illness, injury, allergens and labelling); your breach of these terms or of the law; or your content infringing someone else's rights. This does not apply to the extent the loss was caused by DayDrop's own breach or negligence.

13. Business use and consumer law

You agree that you acquire DayDrop's services in trade, for the purposes of your business. To the extent permitted by law, the parties agree that the Consumer Guarantees Act 1993 does not apply to the services DayDrop supplies to you under these terms, and the parties agree this is fair and reasonable.

14. Liability

To the extent permitted by law:

  • DayDrop provides the platform "as is" and does not promise that it will be uninterrupted, error-free, or that you will make a particular number of sales.

  • Neither party is liable to the other for indirect or consequential loss, or loss of profits, revenue or opportunity.

  • DayDrop's total liability to you in any 12-month period is limited to the subscription fees you paid in that period, or NZ$100 if greater.

These limits do not apply to fraud, wilful misconduct, or your indemnity under section 12 for third-party claims about your products.

15. Accepting these terms, and changes

You accept these terms by reading them in the app, ticking the box and tapping "Accept and continue". We keep a record of the version you accepted and when (with your device type, app version and IP address) as evidence of our agreement. You can see the terms and your acceptances at any time under Account > Vendor terms.

We may change these terms to reflect changes to the Service, the law or our business. We will give at least 7 days' notice of material changes in the app or by email. When a new version takes effect, you need to accept it in the app before you can open a stall or post new drops; existing reservations are not affected. If you do not agree, you can stop selling and cancel before the change takes effect and we will refund the unused portion of any annual fee.

16. General

  • Transfer. We may transfer this agreement to a company that takes over the DayDrop business (including a company formed by the current operator). We will tell you if this happens. You may not transfer it without our consent.

  • Notices. We send notices in the app or to your account email. You can contact us at [email protected] or in the app.

  • Disputes. Contact us first and we will try to resolve it in good faith. These terms are governed by New Zealand law and New Zealand courts have jurisdiction.

  • Whole agreement. These terms, the Privacy Policy and the Acceptable Use Policy are the whole agreement between us about DayDrop.

  • If part of these terms is unenforceable, the rest still applies.
