DayDrop Terms of Use for Buyers
These terms apply when you use DayDrop (the app and daydrop.nz) to find and reserve food and goods from local vendors. DayDrop is operated by Arman Oganesian, a sole trader in New Zealand trading as DayDrop ("DayDrop", "we", "us"). By creating an account you agree to these terms and to our Privacy Policy.
1. What DayDrop is
DayDrop is a listing and reservation platform. Independent local vendors (for example farm stalls, butchers, bakeries and markets) post what they have available. You can reserve items and collect them from the vendor.
The vendor is the seller. When you reserve and collect, your purchase is a contract between you and the vendor. DayDrop is not a party to that sale, does not own, prepare, store or handle the goods, and does not take payment for them. You pay the vendor directly at pickup, using whatever payment methods the vendor accepts.
2. Your account
You must be 16 or older. By creating an account or using DayDrop, you confirm that you are.
Keep your sign-in secure. You are responsible for activity on your account.
Give accurate details and keep them up to date.
You can delete your account at any time in the app under Account > Delete my account.
3. Reservations
A reservation asks the vendor to hold the item for you until the pickup time shown on the listing. It is confirmed when the app shows it as confirmed.
Prices, quantities, descriptions, photos and pickup times are set by the vendor. Check them before you reserve.
Bring your pickup QR code. You have one code per vendor, covering everything you reserved there. The vendor scans it at pickup and records what you take.
Paying: pay the vendor at pickup. The price shown in the app is the vendor's price; the vendor may charge the same or tell you about any change before you pay. The vendor sets the price and is responsible for any GST on it; DayDrop does not take payment for goods.
What the vendor sees: your display name, your profile photo if you added one, and the reservation details. Vendors do not see your email address, phone number or any other account details. You can change or remove your name and photo in the app under Account.
Can't make it? Cancel in the app as soon as you can so the vendor can offer the item to someone else.
No-shows and items not taken: if you do not collect and do not cancel, the reservation is recorded as a no-show. If at pickup you decide not to take something you reserved, the vendor records that too. If this happens often, or you often cancel at the last minute, we may temporarily limit your reservations (for example how many you can hold at once, or reserving at all for a while). We decide whether to do this and for how long at our discretion, taking the circumstances into account. Reservations you already have stay valid, and you can contact us through Support if you think a limit is a mistake.
A vendor may cancel a reservation, for example if they run out or cannot open. We will notify you in the app where we can. DayDrop is not responsible for a vendor cancelling.
4. Your rights under consumer law
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be excluded.
When you buy goods from a vendor for personal use, the vendor gives the guarantees under the Consumer Guarantees Act, for example that food is of acceptable quality and matches its description. If there is a problem with what you bought, contact the vendor first. See our Refunds and Complaints page for how we can help.
5. Food safety and allergies
Vendors are responsible for the safety, labelling and allergen information of their food, and for being registered under the Food Act 2014 where required. DayDrop does not check, inspect or approve vendors, their premises or their food. Any registration details shown on a stall are the vendor's own declaration. If you have an allergy or dietary requirement, ask the vendor directly before you buy. If you think food is unsafe, do not eat it, tell the vendor, and contact the Ministry for Primary Industries (MPI) on 0800 00 83 33 or your local council. Please also report it to us in the app.
6. Using DayDrop properly
Follow our Acceptable Use Policy. In short: be honest, be respectful to vendors and other users, do not make reservations you do not intend to collect, and do not misuse the app.
7. Reports and moderation
You can report a listing or vendor in the app. We review reports and may remove listings, suspend vendors or restrict accounts. We do not have to act on every report, but we take food safety and fraud seriously.
8. The Service
We try to keep DayDrop available and accurate, but we provide it "as is". Listings come from vendors and may contain mistakes. We may change, pause or stop features, and we may suspend or close accounts that breach these terms, immediately and without notice. DayDrop is free for buyers. If we ever introduce a fee for buyers, it will only apply after we give notice in the app.
9. Liability
To the extent permitted by law:
DayDrop is not responsible for the goods vendors sell, for a vendor's acts or omissions, or for any dealings between you and a vendor.
DayDrop is not liable for indirect or consequential loss, or loss of profits or opportunity.
DayDrop's total liability to you for anything relating to the Service is limited to NZ$100.
These limits do not apply to the extent a law (including the Consumer Guarantees Act and Fair Trading Act) does not allow them, or to loss caused by our fraud or wilful misconduct.
10. Changes to these terms
We may update these terms. We will give at least 7 days' notice in the app or by email before a change that affects you materially takes effect. If you do not agree, you can stop using DayDrop and delete your account.
11. General
These terms are governed by New Zealand law, and New Zealand courts and the Disputes Tribunal have jurisdiction.
If part of these terms is unenforceable, the rest still applies.
